Call to Order

The monthly public business meeting was called to order at 7:40 p.m. with the Pledge of Allegiance. The meeting was chaired by Supervisor Parry.  Supervisor Parry informed the public that an executive session was held immediately prior to the business meeting to discuss personnel and litigation issues.

Consent Agenda

  1. Approval and acceptance of the Minutes of the November 7, 2018 Board of Supervisors Regular Business Meeting and the November 29, 2018 Work Session. 
  2. Acceptance of all departmental, committee, commission and council reports as posted and received by the Board of Supervisors for the month of November 2018.

Upon motion by Supervisor Guerette, seconded by Supervisor Donovan, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Consent Agenda.

Treasurer’s Report and Payment of Bills

Supervisor Morrisson, Treasurer, reported to the Board that as of October 31, 2018, the Township’s general fund shows a balance of $3,489,976.89 and stated that in his opinion, the township was ending the year in good fiscal shape.    Supervisor Morrisson reported that the bills for November 2018 have been reviewed and he recommended payment of these bills. 

Upon motion by Supervisor Morrisson, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Treasurer’s Report for the period ending November 30, 2018 and authorized payment of Township bills for the period ending November 30, 2018.

2019 Schuylkill Township Budget

Mr. Mentry, Township Manager, gave a brief overview of the proposed 2019 township budget, stating the general fund budget was just under $7 million dollars; this being less than a half percent increase from 2018.  The proposed budget is balanced with surpluses from prior years making this the 11th year in a row without a tax increase.  No tax anticipation note is needed.  The proposed budget maintains the current staffing levels and service offerings by the township.  Supervisor Guerette noted that the township’s contribution to the Valley Forge Volunteer Fire Company’s operating expenses has been increased by $75,000.00.  There being no further discussion, Supervisor Parry called for a vote.

Resolved upon motion by Supervisor Parry, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township does hereby adopt and approve Resolution 2018-19 to appropriate specific sums estimated to be required for the purposes of the municipal government during the calendar year 2019 for the purposes set forth in the budget documents.

Legal Matters

Mr. Brennan, Township Solicitor, reported that several legal matters had been discussed in executive session, but he had nothing to report for public discussion.

Valley Creek Trunk Sewer Line Sale

Mr. Brennan gave a summary of the history of the Valley Creek Trunk Main lawsuit, settlement and sale transactions and advised the Supervisors that the actions being requested this evening, i.e., approving the resolution and conveyance agreement, are pro forma in nature to enable the transaction to close before the end of 2018.

Resolution 2018-18: Approving the Sale of the Valley Creek Trunk Sewer

Resolved upon motion by Supervisor Parry, seconded by Supervisor Morrisson, and unanimously passed, the Board of Supervisors of Schuylkill Township does hereby adopt and approve Resolution 2018-18 approving the sale of the Valley Creek Trunk Sewer upon the terms and conditions set forth in the Asset Purchase Agreement and Settlement Agreement authorizing the execution and delivery of the Conveyance Agreement and authorizing all necessary actions in connection therewith.

Wastewater Conveyance Agreement

Upon motion by Supervisor Donovan, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township does hereby approve and accept the Wastewater Conveyance Agreement dated December ___, 2018 Valley Creek Trunk Sewer upon the terms and conditions set forth in the Asset Purchase Agreement and Settlement Agreement authorizing the execution and delivery of the Conveyance Agreement and authorizing all necessary actions in connection therewith.

Engineering Matters

Creek Road Stabilization Project

Ms. Lowrie, Township Engineer, reported that Gilmore & Associates, Inc. is preparing a permanent easement document which should be completed next week.  Mr. Brennan advised the Board that negotiations are ongoing with the YMCA regarding the proposed temporary and permanent easements.  Mr. Brennan added that he has been informed by the Township Engineer and the Township Roadmaster that at present the roadbed has been stabilized, it is safe and there is no immediate risk to public safety.  Discussion ensued regarding details of the road stabilization project.  By consensus of the Board, this item was tabled to a date uncertain.

Update: Valley Park Park Culvert Replacement – Ms. Lowrie advised the Board that the culvert replacement was all but complete with only some rip rap remaining to be installed.

High Point Lane Proposed Stormwater Drainage Improvements – With consensus of the Board, this item was tabled to a date uncertain.

Upon motion by Supervisor Parry, seconded by Supervisor Morrisson, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized preparation of preliminary engineering and final design for the 2017 Green Light Go project.

New Business

Appointment of Building Code Official/Zoning Officer - Upon motion by Supervisor Parry, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township appointed Kimberly J. Yocom to be the Schuylkill Township Building Code Official and Zoning Officer with authorization to institute civil enforcement proceedings pursuant to §614 of the Municipal Planning Code until such time as amended by the Board of Supervisors.

Appointment of Building Code Inspector/Code Enforcement Officer/Deputy Zoning Officer - Upon motion by Supervisor Morrisson, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township appointed LTL Consultants, Ltd. of Oley, Pennsylvania as the Schuylkill Township Building Code Inspector, Code Enforcement Officer, and Deputy Zoning Officer until such time as amended by the Board of Supervisors.

Advertisement of 2019 Schuylkill Township Organization Meeting – Upon motion by Supervisor Morrisson, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the advertisement of the 2019 Schuylkill Township Organization Meeting for Monday, January 7, 2019 at 7:00 p.m.

Advertisement of Certified Public Accountant Appointment – Upon motion by Supervisor Donovan, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the advertisement of the appointment of a Certified Public Accountant to perform the 2018 Township Audit and 2018 Tax Collector Audit.

2019 Schuylkill Township Holiday Schedule – Upon motion by Supervisor Guerette, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township approved the 2019 Schuylkill Township holiday schedule of eleven (11) paid holidays.

Historical Commission Advertising Request – Discussion ensued regarding the suitability of using public funds to advertise non-township property as the Meadow Brook farm house is owned by the Phoenixville Area School District.  The consensus was that as the farm house is a Class I Historic Resource in the township’s historic resource inventory, it is to the benefit of the township to assist in locating an individual or entity willing to partner with the school district in the preservation of said resource.  Supervisor Morrisson asked that the advertising costs be split with the school district to avoid setting any kind of precedent.

Upon motion by Supervisor Parry, seconded by Supervisor Guerette, and passed, with Supervisor Morrisson dissenting, the Board of Supervisors of Schuylkill Township approved and authorized the Historical Commission to place an advertisement regarding the availability of historic Meadow Brook farm house for lease in the Preservation Trust Magazine

Resolutions / Ordinances

Resolution 2018-20: Schuylkill Township 2019 Real Estate Tax Rate

Resolved upon motion by Supervisor Parry, seconded by Supervisor Donovan, and unanimously passed, the Board of Supervisors of Schuylkill Township does hereby adopt and approve Resolution 2018-20 Fixing the Township Tax Rate on all Real Property within Schuylkill Township for Calendar Year 2019 at 2.7 mills.

Subdivision / Land Development

Phoenixville Area School District Early Learning Center– Escrow Release #11 FINAL

Upon motion by Supervisor Morrisson, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized Escrow Release No. 11 FINAL for the Phoenixville Area School District Early Learning Center in the amount of one hundred sixty-eight thousand thirty dollars ($168,030.00) as recommended in the Gilmore & Associates, Inc. letter of November 13, 2018 2018 (File No. 13-12010T1).  The amount remaining in the escrow account will be $ 0.00.

Additional Business

The December Board of Supervisors Work Session is cancelled.  The next scheduled Work Session will be Thursday, January 24, 2019 at 7:00 p.m.

  • Valley Forge Volunteer Fire Company Tree Lighting is December 14, 2018.

Public Comment

Executive Session

An executive session was called to order at 8:30 p.m. upon motion by Supervisor Guerette, seconded by Supervisor Morrisson and unanimously passed.  Present were Supervisor Donovan, Supervisor Guerette, Supervisor Morrisson and Supervisor Parry. Also present were the Township Solicitor, Mr. Brennan, the Township Manager, Mr. Mentry, and the Township Secretary, Madeline Harbison.  Mr. Norman Vutz, Schuylkill Township Valley Forge Sewer Authority Board Member was also present.  The public meeting resumed at 8:40 p.m.  Supervisor Parry announced that personnel and litigation matters were discussed.

Adjournment

There being no further business before the Board, the meeting was adjourned at 8:40 p.m. upon motion of Supervisor Guerette, seconded by Supervisor Morrisson and unanimously passed by the Board of Supervisors of Schuylkill Township.
