BOARD OF SUPERVISORS
MEETING DATE: January 24, 2019 -- Public Workshop

The Schuylkill Township Board of Supervisors held their public work session on Thursday, January 24, 2019 at 7:00 p.m.  This is an informal meeting to discuss township related business with the public, without making any motions or voting on any discussed items.  The work session was called to order at 7:10 p.m.  In attendance were Ann Hutchinson and Rick Tralies of Natural Lands and the township’s Ordinance Study Committee members, Jim Morrisson – Board of Supervisors, and Curt English– Planning Commission.  Also in attendance were Supervisors Mark Donovan, Susan Guerette, Martha Majewski, and Fred Parry, and township manager, E.J. Mentry.   Absent were Robert Cooney – Open Space Commission, Michelle Garg – Environmental Advisory Council, Bereth Graeff – Open Space Commission, and Michael Pellegrino – Planning Commission. 

The working meeting’s agenda was a review of the suggested edits to Schuylkill Township SALDO Articles III. , IV, and Article V. as discussed at the November 29, 2018 meeting and the new Zoning Ordinance Sections – Conservation Subdivision Overlay District.

Article III – Plan Processing and Construction Procedures  Discussion ensued regarding the procedural guidelines for the pre-application meeting and preliminary plan submission.  A timeline is to be established for submission of a sketch plan and other materials prior to a pre-application meeting and preliminary plan submission.  Mr. Morrisson pointed out several formatting inconsistencies.  Ms. Hutchinson commented that these would be corrected in the final draft.

Article IV. §320-17 Sketch Plans. E.  Mr. Morrisson requested that a reference to the existing features section be inserted here.  Mr. Morrisson pointed out several formatting inconsistencies.  Ms. Hutchinson commented that these would be corrected in the final draft.

Article IV. §320-18. Preliminary Plan. C.(1)(c).  Mr. Morrisson commented that the designation of a “wetlands biologist” should be further clarified with the inclusion of a definitive certification and suggested Mr. Steve Kunz of the Environmental Advisory Council be consulted as to what this should be.  Supervisor Majewski said she would forward the request to Mr. Kunz.  Ms. Hutchinson advised the committee that this language was taken from the existing Schuylkill Township Code and any update to this section would have to be carried throughout the Code.  Mr. Morrisson pointed out several formatting inconsistencies.  Ms. Hutchinson commented that these would be corrected in the final draft.

Article V. Minimum Design Requirements.  Ms. Hutchinson pointed out that there were some numbering inconsistencies in the new sections to be added to this Article and commented that these would be addressed by General Code when the revised ordinance is codified.

New Zoning Ordinance Sections – Conservation Subdivision Overlay District. Ms. Hutchinson commented that the article and sections numbers would be addressed by General Code when the revised ordinance is codified.  Discussion ensued on cross-referencing to the Conservation Subdivision Overlay District for the FR and R1 Zoning Districts.  Mr. Morrisson requested that all tables be titled for ease of reference. 

Conservation Subdivision Overlay District. §107-Open Space:  Use & Design Standards.8.  This paragraph referencing golf courses will be deleted.  Discussion ensued on whether solar panels should be a permitted use; it was decided to leave the section as is for now.

Conservation Subdivision Overlay District. §109-Open Space:  Ownership & Maintenance.3. Private Conservation Organization.  Reference to Chester County will be removed.

Mr. Morrisson pointed out several formatting inconsistencies.  Ms. Hutchinson commented that these would be corrected in the final draft.

The committee will forward drafts of the amended Articles/Sections to the Township Solicitor and Township Engineer for review and comment.  Their comments will be discussed at the committee’s February 13, 2019 meeting.  Once the committee reaches consensus on the final draft, it will be put before the Schuylkill Township Planning Commission and the Chester County Planning Commission.

The next Ordinance Review Committee meeting dates are February 13, 2019 at 7:00 p.m. and, if needed, March 28, 2019 at 7:00 p.m.
