Call to Order

The monthly public business meeting was called to order at 7:37 p.m. with the Pledge of Allegiance. The meeting was chaired by Supervisor Majewski.  Supervisor Majewski announced that an executive session was held on June 26, 2019, June 27, 2019 and July 3, 2019 to discuss litigation, personnel, contract and land acquisition matters. 

PRD 2019-01 Hearing

Upon motion by Supervisor Donovan, seconded by Supervisor Guerette, and passed, the Board of Supervisors of Schuylkill Township denied the PRD 2019-01 Eagles Pointe at Sedgley Farm Tentative Plan Application and approved the signing of the written Decision as required by Schuylkill Township Ordinance Chapter 252 Planned Residential Development. §252-113.Findings. B.

Mr. Brennan advised the Board that an electronic copy of the Decision will be emailed to the Applicant and Parties this evening and regular copies sent via U.S.  The Decision will be uploaded to the Township website as soon as possible.

Consent Agenda

  1. Approval and acceptance of the Minutes of the May 23, 2019 Board of Supervisors Work Session and the June 5, 2019 Regular Business Meeting. 
  2. Acceptance of all departmental, committee, commission and council reports as posted and received by the Board of Supervisors for the month of June 2019.

Upon motion by Supervisor Morrisson, seconded by Supervisor Donovan, and passed, the Board of Supervisors of Schuylkill Township approved and accepted the Consent Agenda.

Board Member Reports

PRPC - Supervisor Donovan reported that the Board would be voting tonight on the resolution to accept West Vincent Township as a member of the PRPC.

EAC – Supervisor Majewski reported that the Township was investigating litter ordinances.

Treasurer’s Report and Payment of Bills

Supervisor Morrisson, Treasurer, reported to the Board that as of June 30, 2019, the Township’s general fund shows a balance of $4,009.283.  Supervisor Morrisson reported that the bills for June 2019 have been reviewed and he recommended payment of these bills. 

Upon motion by Supervisor Majewski, seconded by Supervisor Donovan, and passed, the Board of Supervisors of Schuylkill Township approved and accepted the Treasurer’s Report for the period ending June 30, 2019 and authorized payment of Township bills for the period ending June 30, 2019.

Board Discussion Items

Subdivision/Land Development

19 Oakwood Lane (Herzog/Piombino) – Request for Waiver of Land Development Process

The Township Engineer advised the Board that the property owner was seeking a 2-lot subdivision and summarized the review process to date.  Mr. Sartor further explained that this was considered a minor subdivision.  The Planning Commission has recommended approval of the land development process.  If the waiver is granted, the applicant will be seeking conditional final plan approval at the next Board meeting.

Upon motion by Supervisor Morrisson, seconded by Supervisor Guerette, and passed, the Board of Supervisors of Schuylkill Township approved and granted a Waiver of Land Development Requirements for the minor subdivision plan requested for UPI # 27-7-10.3, 19 Oakwood Lane.

Valley Forge Meadows - Pulte

  • Request for Waiver from SLDO §320.28
  • Execution of Land Development Agreements

Discussion ensued regarding the conservation easement infringement requested by the developer.  By consensus, the Board tabled the waiver request and land development agreements to a date uncertain.

Old Business

Paul Lemen Drive Improvement Project

Mr. Mentry advised the Board that a recommendation is being made to do minor bank stabilization at the upper part of Paul Lemen with a pipe and culvert installation at the lower end.  This will preserve the road with an estimated cost of $90,000 vs. $300,000 - $400,000.  Discussion ensued regarding the proposed installation.

Upon motion by Supervisor Morrisson, seconded by Supervisor Donovan, and passed, the Board of Supervisors of Schuylkill Township approved and authorized the Paul Lemen Drive Improvement culvert stabilization proposal.

Valley Park Park

The Township Solicitor summarized the need for the Restated Declaration of Public Trust documents in that an additional small parcel of township-owned property was to be included in the Declaration for Valley Park Park.

Resolution 2019-12 Approval of Restated Declaration of Public Trust

Resolved, upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved Resolution 2019-12 to Approve Amended and Restated Declaration of Public Trust, Covenants, Conditions, and Restrictions.

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved the Amended and Restated Declaration of Public Trust, Covenants, Conditions, and Restrictions.

Approval of Payment Application No. 1 – James R. Kenney Excavating & Paving, Inc.

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved and authorized Payment Application No. 1 to James R. Kenney Excavating & Paving, Inc. for the amount of forty-eight thousand nine hundred dollars ($48,900.00) per the July 2, 2019 recommendation of Gilmore & Associates, Inc. (File No. 18-11029T).

Resolution 2019-12 Multimodal Transportation Fund Grant Program Application

Resolved, upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved Resolution 2019-13 to Approve an Application to the Multimodal Transportation Fund Grant Program.

Signal Improvement Project – Charlestown Road/Bridge Street/Pothouse Road

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved and authorized Lenni Electric Change Order No. 2 to install stub pole, replace damaged junction boxes, install and refresh additional pavement markings per the June 28, 2019 recommendation of Gilmore & Associates, Inc. (File No. 16-08052T1).

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved and authorized Lenni Electric Payment Application No. 4 in the amount of forty-two thousand nine hundred seventy-one dollars and ninety-four cents ($42,971.94) per the June 28, 2019 recommendation of Gilmore & Associates, Inc. (File No. 16-08052T1).

New Business

Dog Bite Case - Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the Township Solicitor to appear on behalf of Schuylkill Township at Chester County District Court on July 17, 2019.

West Pikeland Township Membership on PRPC - Upon motion by Supervisor Morrisson, seconded by Supervisor Donovan, and unanimously passed, the Board of Supervisors of Schuylkill Township approved West Pikeland Township’s request for membership on the Phoenixville Regional Planning Committee.

Mr. Mentry reminded the Board that a public hearing should be scheduled for the adoption of the updated PRPC Regional Comprehensive Plan.  The Board concurred and requested this discussion be placed on the June 27 work session agenda.

Resignation of Uday Patankar - Upon motion by Supervisor Majewski, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township accepted the resignation of Uday Patankar from the Schuylkill Township Zoning Hearing Board.

Resignation of Sandra Momyer - Upon motion by Supervisor Majewski, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township accepted the resignation of Sandra Momyer from the Schuylkill Township Historical Commission.

Resolutions / Ordinances

Moved by Supervisor Donovan and seconded by Supervisor Guerette the Board of Supervisors of Schuylkill Township denied approval of the advertisement of proposed Ordinance No. 03 Conservation of Woodlands and Other Vegetation and the transmittal of said Ordinance to the Chester County Planning Commission for review and comment.

Discussion ensued regarding the readiness of the proposal Woodland ordinance.  The Board determined that this ordinance should not be sent to the Chester County Planning Commission and Township Planning Commission without further staff review.

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and passed, the Board of Supervisors of Schuylkill Township approved and authorized the transmittal of proposed Ordinance No. 04 Amending SLDO Chapter 2320 and proposed Ordinance No. 05 Amending Zoning Chapter 370 to the Chester County Planning Commission for review and comment, pending completion of staff review.

Public Comment

Suzanne Rockey, 160 Diamond Rock Road, asked about burn permits and mentioned that a neighbor has been gathering burn piles on his property.  Mr. Mentry informed Ms. Rockey there was no open burning in the township.  Mr. Beittel told Ms. Rockey he knew of the situation and would contact the neighbor regarding the issue.

There being no further business before the Board, the meeting was adjourned at 8:50 p.m. upon motion of Supervisor Guerette, seconded by Supervisor Donovan, and unanimously passed by the Board of Supervisors of Schuylkill Township.
