Call to Order

The monthly public business meeting was called to order at 7:40 p.m. with the Pledge of Allegiance. The meeting was chaired by Supervisor Majewski.  Supervisor Majewski announced that executive sessions were held on April 29, 2019 at the Open Space Commission to discuss land acquisition matters (no quorum of Supervisors was present) and this evening at 7:00 p.m. to discuss litigation matters. 

Consent Agenda

  1. Approval and acceptance of the Minutes of the March 28, 2019 Board of Supervisors Work Session and the April 3, 2019 Regular Business Meeting. 
  2. Acceptance of all departmental, committee, commission and council reports as posted and received by the Board of Supervisors for the month of April 2019.

Upon motion by Supervisor Parry, seconded by Supervisor Donovan, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Consent Agenda.

Board Member Reports

Supervisor Donovan reported that a planning meeting for the Freedoms Music Festival was held on April 13. A date has been tentatively chosen for the festival contingent upon confirmation by The Freedoms Foundation at Valley Forge.  The festival will be held on Saturday, September 14, 2019 with a rain date of Sunday, September 15, 2019

Supervisor Donovan advised the Board that the PRPC is looking at Act 257 review on June 10th.  Any comments must be submitted to the PRPC by their next meeting on May 29, 2019.

Treasurer’s Report and Payment of Bills

Supervisor Morrisson, Treasurer, reported to the Board that as of April 30, 2019, the Township’s general fund shows a balance of $3,250,537.44.  Supervisor Morrisson reported that the bills for April 2019 have been reviewed and he recommended payment of these bills. 

Upon motion by Supervisor Parry, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and accepted the Treasurer’s Report for the period ending April 30, 2019 and authorized payment of Township bills for the period ending April 30, 2019.

Old Business

2019 Association for Pennsylvania Municipal Management (“APMM”) Conference

Upon motion by Supervisor Majewski, seconded by Supervisor Morrisson, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the Township Manager to attend the 2019 APMM Conference on May 14 – 16, 2019 in Lancaster, PA.

New Business

SR 23 Sidewalk Project

Mr. Mentry advised the Board that a proposal was received from McMahon Associates, Inc., a transportation engineers and planners firm, for grant writing coordination and technical assistance for up to two (2) grants for construction funding for this project.  The proposal is for $15,000.00 (fifteen thousand dollars).  Mr. Mentry said that initially this was to be a joint application for a Congestion Mitigation and Air Quality (“CMAQ”) Program grant with the Borough of Phoenixville to tie Schuylkill Township’s Rte. 23 sidewalk into Phoenixville in conjunction with intersection improvements being considered by Phoenixville for the Starr Street/Nutt Road intersection.  The Borough has decided not to make the joint application. The Township Engineer, Gilmore & Associates, Inc., has identified additional grants for which the Township might apply; one being the PA DCED Multimodal Transportation Fund (“MTF”) grant.  Mr. Mentry asked if the Board wished to accept the proposal from McMahon to apply for up to two grants or have the Township Engineer apply for the MTF grant.  Discussion followed regarding the scope of the grants and the grant writing proposals.  The Board considered directing McMahon to make the CMAQ grant application and the Township Engineer to submit an application for the MTF grant.  Supervisor Donovan questioned why the Township would not have its Township Engineer apply for both grants.

Upon motion by Supervisor Majewski, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the Township Engineer to complete and submit an application to the PA DCED MTF grant program for the S.R 23 Sidewalk Project for a not to exceed cost of five thousand dollars ($ 5,000.00).

Upon motion by Supervisor Majewski, seconded by Supervisor Parry, and passed with Supervisor Donovan dissenting, the Board of Supervisors of Schuylkill Township approved and authorized McMahon Associates, Inc. to complete and submit an application to the CMAQ grant program for the S.R 23 Sidewalk Project for a not to exceed cost of seven thousand five hundred dollars ($ 7,500.00).

Roads Department Equipment Purchase

Upon motion by Supervisor Majewski, seconded by Supervisor Parry, and unanimously passed, the Board of Supervisors of Schuylkill Township approved and authorized the purchase of a Marathon UCMK 145T Rubberized Asphalt Kettle for the amount of twenty-seven thousand, six hundred sixty dollars ($27,660.00).

West End Ambulance Support – 2018 Freedoms Music Festival

Mr. Mentry explained to the Board that an invoice in the amount of one thousand eight hundred dollars ($ 1,800.00) was presented to the Township for support services provided by West End Ambulance to the 2018 Freedoms Music Festival.  Mr. Mentry explained that it was not clear if the responsibility for payment for these services rested with the Township or the Festival promotors and asked the Board how they wished to pursue the matter.

Upon motion by Supervisor Majewski, seconded by Supervisor Parry, and passed with Supervisor Morrisson dissenting, the Board of Supervisors of Schuylkill Township approved and authorized the payment of the West End Ambulance invoice for one thousand eight hundred dollars ($ 1,800.00).

Solar Panels – New Roads Department Garage

Supervisor Majewski advised the Board that the township’s Environmental Advisory Council (“EAC”) was requesting that consideration be given to incorporating solar panels on or next to the new garage building to be constructed.  Supervisor Majewski said that this expense was not in the 2019 budgeted amount for the garage project but if the Board wishes to consider it, it could be allocated in 2020.   The Township Engineer explained that there are concerns about solar panels on the roof of the new building as it has not been designed for the best use of solar panels nor has it been engineered to carry the load.  The Board directed the EAC to investigate the cost of solar panel installation for the building as well as any financing options/incentives available for solar panel installations.

Resolutions / Ordinances

Public Hearing on Proposed Ordinance 2019-02 To Amend the Code of Ordinances of Schuylkill Township to Repeal Chapter 252 Planned Residential Development.

The public hearing on proposed Ordinance No. 2019-02 was opened at 8:20 p.m. by the Township Solicitor.  Mr. Brennan introduced certain documents into the record which are incorporated herein by reference; those being T-1. Certificate of Posting, T-2. Proof of Publication, T-3. Written Notice to the Property Owner and Counsel dated March 29, 2019, T-4. Chester County Planning Commission Review Letter, T-5. Natural Lands Trust Report on Housing.  Mr. Brennan reported that the Schuylkill Township Planning Commission reviewed this ordinance on April 17, 2019 and took no action.  Mr. Brennan called for public comment.  Mr. Norman Vutz, 630 Country Club Road, asked which zoning district(s) would be affected.  Mr. Brennan responded that the underlying district on the property in question is R-1.  There being no further public comment, Mr. Brennan requested that the Chair call for a vote on the ordinance and to advertise notice of adoption.

Upon motion by Supervisor Donovan, seconded by Supervisor Guerette, and passed with Supervisor Parry dissenting, the Board of Supervisors of Schuylkill Township does hereby adopt and enact Ordinance 2019-02 To Amend the Code of Ordinances of Schuylkill Township to Repeal Chapter 252 Planned Residential Development and approved advertising notice of said adoption.

The public hearing was closed at 8:25 p.m.

Resolution 2019-11 Participation in Blacktop Costars Contract

Resolved upon motion by Supervisor Parry, seconded by Supervisor Guerette, and unanimously passed, the Board of Supervisors of Schuylkill Township does hereby adopt and approve Resolution 2019-11 authorizing Schuylkill Township’s participation in Pennsylvania State Contract No. 561036ITQ entitled Bituminous Material, Plant Mixed, Districts 1-12 by purchasing material from Independence Construction Materials, Glasgow and Highway Materials based upon the terms and conditions of the contract.

Public Comment

Susanne Rockey, 160 Diamond Rock Road, questioned why the Township Planning Commission reviewed the Eagles Pointe application at their April meeting.  The Township Solicitor responded that this review is required by ordinance.

There being no further business before the Board, the meeting was adjourned at 8:40 p.m. upon motion of Supervisor Parry, seconded by Supervisor Donovan, and unanimously passed by the Board of Supervisors of Schuylkill Township.
