NOTICE

 

            THE SCHUYLKILL TOWNSHIP ZONING HEARING BOARD will meet at 7:00 p.m., prevailing time, on Tuesday, March 21, 2023, at the Schuylkill Township Building, 111 Valley Park Road, Phoenixville, Pennsylvania, to hear the following:

 

            THE APPLICATION OF PROVCO PINEGOOD PHOENIXVILLE, LLC, APPLICATION #2022-10. The properties are UPI Nos. 27-6A-32, 27-6A-33 (799 Valley Forge Road, 27-6A-33.1 (715 Valley Forge Road), and 27-6A-31 (30 North White Horse Road). The Applicant is the equitable owner of the properties, which are located in the C – Commercial District of the Township and total approximately 2.879 acres. The Applicant proposes to demolish the existing Exxon convenience store and fuel dispensing facilities and redevelop the parcels collectively as a Wawa convenience store with ten (10) fuel dispensing stations and associated parking. The Applicant appeals a November 18, 2022 Zoning Officer Determination regarding variance relief required for the proposed continuance of existing non-conforming conditions on the subject properties. Alternatively, the Applicant seeks variances from the following sections of the Schuylkill Township Zoning Ordinance: §§370-79, 370-87 (Lot size, height, area, and bulk regulations) and §370-169.N (Convenience store) to permit a fueling canopy with a setback of 35.7 feet along Valley Forge Road where 50 feet is the required front yard setback and a fueling canopy with a setback of 45.4 feet along North Whitehorse Road where 50 feet is the required setback; §370-169.C (Convenience store), to permit a fueling canopy to be located 50.7 feet from the legal right-of-way of Valley Forge Road where 75 feet is the minimum required distance and 35.7 feet from the ultimate right-of-way of Valley Forge Road where 50 feet is the minimum required distance; §370-169.C (Convenience store), to permit a fueling canopy to be located 59.3 feet from the legal right-of-way of North Whitehorse Road where 75 feet is the minimum required distance and 45.4 feet from the ultimate right-of-way of Valley Forge Road where 50 feet is the minimum required distance; §370-132.E(3) (Accessory use structure) to permit an accessory building or structure larger than 150 square feet to exceed the yard regulations of the C – Commercial District; §370-132.K (Accessory uses) to permit an accessory structure that exceeds 750 square feet where it is otherwise not permitted; §370-183.C (Required yards) to permit proposed parking setbacks of 3.1 feet along Valley Forge Road and 10.7 feet along North Whitehorse Road, where 25 feet is the required front yard setback; §370-183.C (Required yards) to permit proposed parking setbacks of 11.2 feet along Valley Forge Road and 0.0 feet along North Whitehorse Road, where 12.5 feet is the required side yard setback; and §370-177.B(2)(a) (Administrative Research, Commercial and Industrial District regulations) to permit two freestanding signs and two wall signs where only three signs are permitted, to permit a sign area of 67.70 square feet for a single sign area where 50 square feet is the maximum permitted sign area, and to permit an aggregate sign area of 223.05 square feet where the maximum permitted aggregate sign area is 100 square feet; §370-133 (Landscaping) which incorporates by reference §320-34.D(5)(c)(1) (Design standards) of the Subdivision and Land Development Ordinance, to allow a perimeter landscaping width of 0.6 feet along Valley Forge Road and 0.0 feet width along North Whitehorse Road where 10 feet is the minimum required perimeter landscaping; additional variance relief to permit the existing non-conforming conditions to remain on the properties as to front yard setbacks, side yard setbacks, and front yard parking; and any other such relief deemed necessary by the Zoning Hearing Board.  

 

The Board may consider other such matters as may properly come before it.
